Non-Subscription to Workers' Compensation in Texas

In addition to leading OccMD Group P.A., Dr. Melissa Tonn serves the University of Texas at Austin's Dell Medical School as a clinical assistant professor in its population health department. One major focus of Dr. Melissa Tonn's work is workers' compensation, and she has collaborated with many of the responsible non-subscribers to workers' compensation in Texas.

In Texas, employers do not need to subscribe to the state-regulated workers' compensation program. A non-subscribing business must report its decision to opt out of the program each year. These employers must also report occupational diseases, injuries resulting in more than one day of lost time, and work-related fatalities to the state's Department of Workers' Compensation.

Non-subscribing employers can purchase other accident, disability, and health insurance policies to provide benefits to an injured employee. The state does not consider these to be substitutes for program participation, however, and still requires subscribers to report their non-subscription status annually.
