Will Requirements in Arizona

In addition to presiding over Bergen Financial Group, financial advisor Darcy Bergen works as a fiduciary. In the financial workshops he holds across Arizona, Darcy Bergen translates complex topics into relatable terms for audiences made up of seniors.

In Arizona, the legislature distributes the assets of residents who die without a legal will. Under the state law of intestate succession, children, spouses, and parents are the primary beneficiaries of an estate. In rare circumstances where none of these parties are available, the estate of the deceased may become the property of the state.

Spouses are protected from being completely disinherited by state law. Unless the money is waived in a prenuptial or postnuptial agreement, spouses are entitled to at least $37,000 and will be paid ahead of the deceased's creditors.

Arizona residents can write a legal will after the age of 18 if they are mentally fit. Wills must include the signature of two observing parties.
