In Illinois, wrongful death is defined by statute as death caused by a wrongful act or neglect in such circumstances as, if death had not occurred, would have entitled the injured person to a claim for damages. The person who perpetrated the wrongful act or was negligent is liable for wrongful death. 

A suit for wrongful death is a civil suit filed by the deceased’s personal representative and is brought for the benefit of the estate. The representative may be a relative such as a spouse, parent, or adult child, or a person appointed by the deceased in his or her lifetime through a will.
