DIFS Finds Solution for Survivors of Car Accidents

Under Michigan's new car insurance law, uninsured vehicle passengers and pedestrians who survived car accidents before July 2, 2020 are assured of unlimited Personal Insurance Protection (PIP) medical coverage. The Michigan Department of Insurance and Financial Services (DIFS) has found a solution to ensure all affected persons continue to receive medical coverage as mandated by Michigan law.

Under Michigan laws, PIP medical coverage includes payment of medical care, recovery, and rehabilitation of people who survived car accidents. Through the Michigan Assigned Claim Plan (MACP), uninsured vehicle passengers and pedestrians receive unlimited PIP medical coverage. However, the new car auto insurance law has placed the maximum medical coverage to $250,000 for claims beginning July 2, 2020. Affected persons who sustained their injuries between June 11, 2019 (when the new law was signed) and July 2, 2020 (when the new law takes effect) faced uncertainty about their coverage because of varying interpretations of the law.

The DIFS, through Order 19-049-M, has clarified that MACP will continue to provide unlimited PIP medical coverage to uninsured vehicle passengers and pedestrians who sustained their injuries before July 2, 2020. The order was upheld by the Michigan Court of Claims after its legality was challenged.
