Cybersecurity deficiency That Result in Legal Liability

A thought leader in risk and cybersecurity, Sai Huda is the author of the best-selling book, Next Level Cybersecurity and the Cyber Risk Guide, a board cybersecurity oversight best practices guide. At a recent Procopio webinar, Sai Huda spoke on the topic, “The Cybersecurity Deficiencies That Create Liability.” This topic focused on organizational cybersecurity deficiencies and suboptimal practices that create liability under unfair or deceptive acts or practices (UDAP) federal and state laws.

At the webinar, Sai Huda revealed how deficiencies led to UDAP liability totaling more than $700 million in one high profile case. In another case even though it did not involve data breach or theft, UDAP liabilities totaled thousands of dollars over five years. These types of cases are only becoming more prevalent and catching organizations of all types by surprise.

In his talk, Mr. Huda explained the linkage between privacy, cybersecurity deficiencies and UDAP liability. He then revealed how to implement "reasonable security" in order to mitigate UDAP liability risk, and how to proactively identify and remediate cybersecurity deficiencies. The educational webinar was focused on educating board, C-level executives and business owners, as well as in-house legal counsel, privacy and cybersecurity management.
