Tribal Supreme Court Project Strives to Protect Native

Leading the Pechanga Band of Luiseno Indians in Temecula, California, Mark Macarro works to strengthen the tribe’s economic resources and political influence. Mark Macarro pursues these goals in part by participation in the National Congress of American Indians (NCAI).

In cooperation with the Native American Rights Fund, NCAI sponsors the Tribal Supreme Court Project, which advances the interests of early Americans by representing them before the United States Supreme Court.

The initiative began in 2001, after Supreme Court decisions were made that affected tribes’ abilities to tax non-Native American businesses operating on reservations and apply their laws to non-native persons inside them. Some 250 attorneys, legal scholars, and tribal leaders have joined this effort to mitigate or reverse the impact of these rulings.

The project informs this network of new developments in federal and state courts that could reach the Supreme Court and maintains online documentation of such proceedings. During the appeals process, it helps lawyers file writs of certiorari to bring cases from lower to higher courts. The program also assists parties with similar interests to file amicus (friend of the court) briefs to present additional relevant information to the courts. 

Additionally, the project conducts research, edits briefs, plans strategy, and helps attorneys prepare oral arguments before the Supreme Court.
